3:Terms and Conditions for Garden & Exterior Construction Work
- NJ Garden Services is committed to providing the best possible garden construction experience for our customers in a profession thwart with uncertainty, however not every eventuality can be foreseen. We recommend that you read and understand all the points in the terms and conditions.
- Please bear in mind that during construction your garden is classed as a building site. Our staff are trained to make them as safe as reasonably possible. We recommend that children and pets are not permitted to enter the site until work is complete, and all persons entering the confines of the working area are either competent or supervised.
- Vandalism, acts of God or outside negligence. During the construction NJ Garden services will take reasonable steps to protect the work, however cannot be held responsible for acts of wanton vandalism or unexpected occurrences such as extreme weather conditions or any other event that one could not reasonably predict.
- Any changes to the agreed work need to be discussed and a new price agreed before commencement of extra or changed specifications
- A non refundable booking deposit may be expected to secure a scheduling date* that will be deducted from your final invoice. All material costs will need to be paid in advance on the outset of the work. An interim payment during construction of 50% of remaining balance at an approximate half way point if the work is planned for more than five days. Final invoice is to be settled on satisfactory completion of work. A charge of 1 % per day may be applied to any outstanding sums after one week from the satisfactory completion of work unless agreed otherwise.
- Construction materials of the highest quality will be sourced however NJ Garden Services cannot be held responsible for manufacturing defects. Please take note of the attached statement issued by timber suppliers, our live products policy and the natural stone installation terms if applicable.
- Please note that in the last few years NJ Garden Services has noticed a decline in the quality of timber posts available on the market. This has been the case in many types and manufacturers including the better quality brands. NJ Garden services will take steps during installation to prevent this early failure of posts but will not replace after two years.
- Weed suppressing geo-textiles are not 100% effective. A good quality textile will have a significant impact on weed growth in a treated area but will not completely arrest their spread.
- NJ Garden Services is not a qualified electrical contractor therefore any electrical installations installed will need to be checked and approved by an electrician with the appropriate authentication. Electrician’s fees are generally not included in our quoted price unless agreed.
- NJ Garden Services may use images of the work to promote business on the internet or other mediums. If you object to this then please let us know. No location details will be published or passed on to other parties without your permission.
- Surplus materials remain the property of NJ Garden Services unless the customer has made a direct payment to the supplier for them.
- While we endeavour to proceed and complete the work on the given dates circumstances beyond our control sometimes cause short delays. No compensation for reasonable minor delays will be offered unless agreed on booking.
- We strongly recommend that you do not make unchangeable plans in the week(s) immediately following the expected completion times that will affect the construction should we be delayed.* A secure schedule date refers only to your place in the queue, not a promise to start on the predicted date. If the start and / or completion date is imperative this must be made clear during negotiations.
- If available water and electricity must be made accessible to the construction crew. If you do not wish to make water and electricity available the cost of importing these services may be added to the cost of the work as these are not included in the price unless stated in the quotation.
- The site must be made available at all times to the construction crew during the agreed construction period. If access through your property is required then this must be made available regardless of your presence and necessary precautions to protect carpets and walls will need to be approved as adequate by you.
- A strike to an underground service is always a possibility whenever excavation of any kind is carried out. In a high risk situation every care is taken to preserve any gas, water, electricity or telephone cables however NJ Garden services cannot be held liable for expenses incurred by the utility companies in such an event unless we are provided with accurate service locations. We will carry out scanning to reduce the likelihood of a service strike but these do not guarantee incident free excavating. We can offer a reasonable insurance policy depending on the risk factor whilst excavation is in progress. If the risk is high we will inform you before excavation proceeds.
- No spoils, rubbish or waste will be removed from site for disposal unless specified in the quote. In the event of toxic waste been uncovered during excavation, NJ Garden Services will not be held liable for the costs of the professional removal of the materials. NJ Garden Services will assist in the removal of materials if possible however any unexpected costs will be added to the final invoice.
- In the event of damage or destruction caused by an explosion not triggered by our activity, all costs up to the point of the explosion, and costs caused by the explosion will be paid by the client. In the event of an explosion caused by an unexploded device hidden underground that is triggered during excavation, all costs up to the point of the explosion, and costs caused by the explosion will be paid by the client. This does not include loss of life or injury costs.
- The quoted price is to carry out the work described. Sometimes jobs take longer than expected and sometimes they take less time than expected. This is what is known as “win some, loose some”. As long as changes to the specifications have not been made after construction has begun no compensation for early finishing will be made just as no extra expense will be incurred if the work takes longer.
- To ensure quality and efficiency, the foreman on site will be working under contract to NJ Garden Services and is responsible for the day to day running of the work. He will be monitored and supported daily by an operations manager. NJ Garden Services will carry out the logistics, waste control & financing and is responsible for the quality and correct installation of the work.
- NJ Garden Services recommends that you commission a professional drawing of the work to be carried out. This is not included in our quotation and if no drawing or specifications is available installations will be constructed with either customer guidance or as the operations manager on site understands the customers’ vision. Without a professional drawing, clear specification or customer guidance no installations can be reconstructed without incurring extra costs.
- Sometimes difficult weather conditions can cause delays to the final touches of work. In these circumstances settlement of the invoices minus the value of the uncompleted work will be expected.
- Dig out from existing levels will be no more than 150mm unless specified otherwise in the quotation. No allowance has been made in the quotation for any unforeseen scenarios such as concrete sub bases or drainage systems. Extra excavation and disposal costs may be added to the final invoice.
- N.J.Garden Services offers a two year guarantee against incorrect installation so long as the installation has been used for the purposes that it was designed for.
- Accepting the quotation is an automatic acceptance of the terms and conditions. If there are any points in the terms that are not acceptable please contact us for discussion.
